CONDITIONS OF SALE
pursuant to Article 7 of Legislative Decree No. 70/2003 and Legislative Decree No. 185/99 governing the stipulation of distance contracts and GUARANTEES for the buyer.
Parties to the sale
Supplier: the company Persian House snc, registered office in Via Nirone 2, 20123 Milano –, entered into the Chamber of Commerce of Milan with registration No. 1671678 on 07 March 2002, VAT No. 03389710967 (hereinafter referred to as the Supplier).
Customer: the physical or legal person identified by the information entered in the system at the time of registration and acceptance of these general conditions of sale (hereinafter referred to as the Customer).
Provided service.
Through the e-commerce service, the Supplier puts at the disposal of the Customer a virtual store where it is possible to look at and purchase on-line hand-made rugs according to different techniques. The Customer may look at the electronic catalog and Supplier’s offers and make a purchase from the Supplier in compliance with these conditions of sale.
Technology and security.
To guarantee secure transactions, when processing payments made with credit cards, our system uses the Banca Sella technology, which is based on 128 bit Triple Des SSL3.
Protection of Privacy .
The Supplier wishes to inform the public that it is possible, without registering, to access the site www.tappeti.it and read all the information herein contained, the products catalog and the price list, and use all those services for which one does not need to enter personal data. In order to use other services such as the newsletter and on-line purchase, it is necessary to enter the requested data. Submission of data is not obligatory but only necessary to establish and maintain the contractual relationship existing with the Supplier, which cannot be established without the communication of such data. Customers are entitled to exercise all the rights provided for by Legislative Decree No. 196/2003 in relation to such data.
The data submitted by or, in any case, referring to Customers may be transmitted by the Supplier to the following subjects:
- Outsourced third parties providing specific services on behalf of the Supplier (couriers, manufacturers of ordered items, companies providing administrative and accounting services, revenue authorities, information systems outsourcers and marketing analysts);
- Banks, to handle payments and collections of money related to the completion of the sale contract.
Nature of the contractual relationship and instances for which the regulations on consumer protection shall not apply
In compliance with the provisions laid down by national and European regulations currently in force, the contractual relationship existing between the Supplier and Customers shall be governed by the laws on consumer protection exclusively when Customers purchase the goods for personal purposes only and not in relation to their business or work activities. Hence, the regulations on consumer protection, and in particular Legislative Decree No. 185/1999, governing the stipulation of distance contracts, Legislative Decree No. 50/1992 on cancellation rights and Article 1469 bis and following articles of the Italian Civil Code, shall not apply to the relationship existing between the Supplier and Customers who purchase the goods for purposes inherent to their business activity, and for which they intend to make payments against the issue of an invoice.
Prices and guarantees
Unless otherwise stated in writing, all indicated prices are inclusive of sale taxes (VAT) and expressed in Euros. The validity of marked prices shall always be the one indicated by the procedure shown when placing the order with the Supplier. In fact, the prices of some or all items may repeatedly vary during a single day without the obligation for the Supplier to notify such variations. For each ordered item, a sale receipt shall be issued and sent along with the purchased goods. On request, an invoice may be issued and sent along with the goods. The Supplier shall not be responsible for any tax imposed by and payable in other countries. Each item is accompanied by a certificate of origin indicating the dimensions of the item, quality, place of origin and type of manufacture (e.g., a hand-knotted rug). Shipment costs by courier in Italy are € 15.- with an additional € 6.- for payments on delivery.

In this case, we will ship the goods once we have received confirmation of payment from the bank

Please note that the Supplier, once all the necessary checks have been completed, will withdraw the amounts due on the exact day on which orders are processed. Therefore, payments are actually made in that very moment. In this way, Customers are guaranteed that, in case of shortage of goods or delays in shipping them, due to reasons for which the Supplier is not responsible, no payments shall be made on their account before orders are processed.
Purchase orders.
Each order is marked by a unique code (order number) and contains indication of the date of order submission in the system, a detailed list of the purchased items, shipments costs, the price of each single item, inclusive of VAT taxes and expressed in Euros, and the total sale amount, inclusive of VAT taxes. Receipt of orders through the electronic system under any circumstances shall constitute an obligation for the Supplier, unless the Supplier has sent a written order receipt confirmation by e-mail to the address notified by the Customer at the time of registration. Customers can track the status of their orders online by visiting their Account at the site www.tappeti.it, after entering User Name and Password from their own reserved Personal Area.
Delivery methods and times.
The Supplier may ship the goods by express courier or the Customer may choose to pick up the items at the store of the Supplier, or have them delivered at any other terms, as agreed with the Supplier. Shipment costs by express courier in Italy are € 15.- with an additional € 6.- for payments on delivery. All such costs and other expenses that might be related to the shipment and/or delivery of the products shall be indicated and included in the order confirmation and sale invoice. Upon receipt of the goods at his/her address, the Customer shall verify that packages have not been tampered with and that the content match the quantity and quality described in the shipment documents.
In case of discrepancies and/or irregularities, the Customer shall be responsible for having them noted in the shipment documents (packing list or bill of lading) under penalty of losing any rights related thereto. Average delivery time is 2-3 working days as indicated by the express courier, who shall be the only person responsible for any delay or poor service. At the time of shipment of the items, Customers will be notified by e-mail all the information they need to track their orders online.
Complaints and delays in shipment.
Customers shall be entitled to verbally communicate any problem that might arise in connection with their orders (misdelivery, mishaps or delays) by telephone, at the number +39-02-8690689, or in writing at the following e-mail address: info@tappeti.it.
Such complaints shall be treated at once in order to solve the inconvenience and guarantee 100% customer satisfaction.
Cancellation policy.
Written instructions regarding the cancellation policy are sent with each order to the Customers. Dissatisfied customers may exercise their cancellation rights (pursuant to Legislative Decree of 22 May 1999 No. 185 on consumers’ protection in distance contracts) within a term of 10 working days from receipt of the goods, sending a written communication by certified mail with return receipt to the following address: “Persian House snc - Via Nirone 2 - 20123 Milan”. Such notice of cancellation may also be submitted, within the same term, by telegram, provided that the original copy is sent by certified mail with return receipt within the following 48 hours. Moreover, in order to receive reimbursement, customers shall ship back to the Supplier address (Via Nirone 2 – 20123 Milan) the purchased items within 10 days. Customers are entitled to return and receive reimbursement for the goods without being subject to any penalty. Customers shall only be responsible for the expenses related to the return of goods, with the exclusion of those related to the first shipment which are entirely on the account of the Supplier. As part of a fair and balanced relationship, Customers hereby agree to store and preserve with utmost care and diligence the goods for which they intend to exercise their cancellation rights. Goods shall be kept intact in their original packaging. Customers shall be entirely responsible for all expenses and risks inherent in return of goods. The Supplier shall not accept goods that are no longer intact, are damaged or lack the original accessories or optional equipment. Such goods shall be returned to the Customer who shall bear all the expenses related thereto. Once the goods have been received as above described and all the necessary checks have been completed, the Supplier shall reimburse the Customer. The Supplier hereby agrees to complete all reimbursement procedures, by bank wire transfer, within thirty working days from receipt of the notification with which the Customer had manifested his/her intention to exercise the cancellation rights.
Guarantees of the Customer.
Customers shall guarantee that the data submitted at the time of acceptance of these general conditions of sale are truthful and allow us to determine the true identity of said Customers, who shall remain responsible for any misleading information or misinterpretation and shall relieve the Supplier of any harmful consequences related thereto. Customers hereby also agree to immediately inform the Supplier in writing – even by e-mail – of any changes occurring in the data submitted. Customers are hereby informed that they are under the obligation to notify to the Supplier a valid e-mail address in order for the Supplier to send the relevant order confirmations and other necessary communications.
Limitation of liability .
The Supplier accepts no responsibility in relation to malfunction, discontinuation of service or poor performance, whether or not as a result of force majeure or fortuitous event, provided that these are not directly attributable to the Supplier’s willful deception or gross negligence
Validity of electronic communications.
Customers hereby accept that the Supplier is to send notices and communications related to all online services (including those related to purchase orders) by electronic mail and through web services. Customers shall acknowledge the full validity of this means and hereby expressly waive any right to reject the content of all communications sent and/or received in electronic format.

Cost of online services
For all online services provided through the website, Customers shall incur only the charges applied by the Customers’ own internet service provider. Please contact your internet service provider for any additional information about costs
Applicable law.
The laws of the Italian Republic shall exclusively apply to all e-commerce services provided through the website www.tappeti.it.
Pursuant to Articles 1341 – 1342 of the Italian Civil Code, the Customer hereby declares that he/she has read and therefore specifically accepts the clauses referred to in the following articles of the general conditions of sale on the website tappeti.it: Article 7 (Time limit for the receipt of complaints); Article 12 (Guarantees of the Customer); Article 13 (Limitation of liability); Article 14 (Validity of electronic communications); e-commerce: informative note on protection of privacy and personal data processing..
